1. Introduction
Welcome to Omega Trade Group, a global merchant exporter of premium organic products from India. By accessing and using our services, you agree to the following terms and conditions. Please read them carefully before proceeding.
2. Scope of Services
Omega Trade Group specializes in the export of high-quality organic products. Our offerings include but are not limited to organic fruits, vegetables, spices, and grains, which comply with international organic certification standards.
3. Eligibility
By using our website or placing an order, you confirm that you are at least 18 years old and legally capable of entering into binding contracts.
4. Orders and Payment
4.1 Order Process:
All orders must be placed through official communication channels, including email or our website. Each order will be confirmed in writing before processing.
4.2 Pricing:
All product prices are quoted in U.S. dollars (USD). Prices are subject to change without prior notice. Any price changes will not affect orders already confirmed.
4.3 Payment Terms:
- Payment can be made via SWIFT, Irrevocable LC (Letter of Credit), or any other mutually agreed-upon payment method.
- A minimum of 50% of the total order value must be paid in advance before shipment.
4.4 Proforma Invoice Validity:
The proforma invoice issued by Omega Trade Group is valid for a period of 7 days from the date of issuance. If the order confirmation is not received within this period, the proforma invoice will be considered void, and a new invoice may be issued based on updated pricing or terms.
4.5 Taxes and Duties:
All applicable taxes, import duties, and other levies in the destination country will be the responsibility of the buyer.
5. Shipping and Delivery
5.1 Shipping Terms:
We offer shipping to most international destinations. Shipping terms will be defined based on the Incoterms agreed upon with the buyer (FOB, CIF, etc.).
5.2 Delivery Time:
Delivery timelines depend on the shipping destination and mode of transport. Estimated delivery dates will be communicated once the order is confirmed. Delays caused by third-party carriers, customs, or unforeseen circumstances are beyond our control.
5.3 Risk of Loss:
The risk of loss or damage to products will pass to the buyer once the goods are delivered to the designated carrier, as per the agreed shipping terms.
6. Product Quality and Certifications
6.1 Organic Certification:
All products exported by Omega Trade Group are certified organic, adhering to global organic standards. Certificates of organic authenticity can be provided upon request.
6.2 Product Inspections:
We conduct stringent quality inspections before dispatching any order. Buyers have the right to request third-party inspections at their own expense.
6.3 Product Shelf Life:
Organic products are perishable by nature. Buyers must ensure proper storage conditions upon receipt to maintain product quality and shelf life.
7. Cancellation and Returns
7.1 Order Cancellation:
Cancellations are allowed only if made within 48 hours of order confirmation. After this period, cancellations are subject to a 20% restocking fee.
7.2 Returns and Refunds:
Due to the perishable nature of our products, returns are not accepted unless the product delivered is defective or does not meet the agreed specifications. In such cases, refund or replacement requests must be made within 7 days of receiving the shipment.
8. Liability
Omega Trade Group shall not be held liable for any indirect, incidental, or consequential damages arising out of the use or inability to use our products. Our maximum liability is limited to the amount paid for the product in question.
9. Force Majeure
Omega Trade Group shall not be held responsible for delays or failures in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, labor strikes, governmental restrictions, or acts of God.
10. Dispute Resolution
In the event of any disputes, the matter shall be resolved amicably through mutual negotiations. If unresolved, the dispute shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration proceedings shall take place in India.
11. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of India. Any legal disputes shall be subject to the exclusive jurisdiction of the courts in India.
12. Amendments
Omega Trade Group reserves the right to amend these terms and conditions at any time. Any changes will be effective immediately upon being posted on our website.
